ALPHA-IMPERIUM

Terms and Conditions

1. Promoter

  1. The Promoter is: ALPHAIMPERIUM LTD, Company Registration Number 17094505, whose registered office is at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ.
  2. If you wish to contact us for any reason, please email contact.alphaimperium@gmail.com.

2. The Competition

  1. These terms and conditions (“T&Cs”) apply to all competitions listed on the Promoter’s website at alpha-imperium.com (the “Website”), including standard competitions (“Standard Competitions”) and online “instant win” competitions (“Instant Win Competitions”), and shall apply to all relationships between the Promoter and you. Together, Standard Competitions and Instant Win Competitions shall be referred to as “Competitions” in these T&Cs, and references to a “Competition” shall refer to either a Standard Competition or an Instant Win Competition.
  2. In the event of any conflict between these T&Cs and any competition listing on the Website, advertisement, or other material used by the Promoter to promote a Competition, these T&Cs shall prevail.
  3. In order to have a chance of winning, all entrants to a Competition (an “Entrant”) must correctly answer a question or solve a problem set by the Promoter (the “Competition Question”).
  4. All Competitions include a Competition Question and an entry fee is payable each time you enter a Competition. Where the Promoter provides an easy or multiple-choice question, a free entry route is available.

3. How to Enter

  1. Competitions will run from and include the opening and closing dates specified on the Website. These dates shall be referred to as the “Opening Date” and the “Closing Date” respectively. All times and dates referred to are London, England times and dates.
  2. If absolutely necessary, the Promoter reserves the right to change the Opening Date and/or the Closing Date. If the Promoter changes the Opening Date and/or the Closing Date of a Competition, the new details will be displayed on the Website.
  3. All Competition entries must be received by the Promoter no later than the time specified on the Closing Date. Subject to clause 3.12.6 below, all Competition entries received after the specified time on the Closing Date are automatically disqualified and no refunds will be given.
  4. The maximum number of entries to a Competition will be stated on the Website. The number of entries you may make may be limited if the maximum number of entries is reached.
  5. Entries, including free entries, are limited per person per Competition. The maximum number of entries permitted per Entrant for a Competition will be listed on the relevant Competition webpage on the Website. No further entries will be permitted if the maximum number of entries for the Competition has been reached.
  6. To enter a Standard Competition using the paid entry route:
    1. go to the Website and view the Standard Competition you wish to enter; then
    2. submit your answer to the Competition Question; then
    3. select the required number of entries and proceed to checkout; then
    4. log in or register if you are not already logged in; then
    5. accept these T&Cs and complete your purchase.
  7. To enter an Instant Win Competition using the paid entry route:
    1. go to the Website and view the Instant Win Competition you wish to enter; then
    2. select the required number of entries and proceed to checkout; then
    3. log in or register if you are not already logged in; then
    4. accept these T&Cs and complete your purchase.
  8. Use of PayPal is restricted to persons aged 18 and over. Please refer to the PayPal terms and conditions that apply to your use of PayPal.
  9. If you purchase an online Competition entry, the Promoter will send you confirmation that your entry has been received.
  10. The Promoter accepts no responsibility for Competition entries that are not successfully completed, are lost, or are delayed for any reason, including, for example, as a result of any equipment failure, technical malfunction, systems failure, satellite, network, server, hardware, or software failure of any kind.
  11. By purchasing entries and/or submitting a Competition entry (whether purchased online or submitted as a free entry), you confirm that you are eligible to enter the Competition, acknowledge that you are entering into a contract with the Promoter, and agree to be bound by these T&Cs.
  12. You may enter a Competition free of charge (whether a Standard Competition or an Instant Win Competition) by complying with the following conditions:
  • Send your entry by prepaid first or second class post to the Promoter at the following address: 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ.
  • Hand-delivered entries will not be accepted and will not be included in the draw.
  • You must include the following information with your entry:
    • details of the Competition you wish to enter;
    • your full name;
    • your date of birth;
    • your postal address;
    • a contact telephone number and email address; and
    • your answer to any Competition Question.
  • Incomplete or illegible entries will be disqualified.
  • You may submit multiple free entries for any Competition, up to the limit imposed by the Promoter (the maximum number of entries permitted per Entrant for a Competition will be listed on the relevant Competition webpage on the Website). However, each free entry must be completed and posted to the Promoter separately. Bulk entries in one envelope or on one postcard will not be accepted as multiple entries, and if a bulk entry is received, it will be treated as a single entry.
  • Your entry to a Competition must be received by the Promoter before the Closing Date and before all tickets in the Competition have been allocated. Free entries received within 48 hours of the Closing Date for a Competition in which not all tickets have been sold/allocated will not be entered into the selected Competition, but the Entrant will be given account credit on the Website equal in value to the same number of entries via the paid entry route for the relevant Competition. Free entries received after the Closing Date will not be credited to the Entrant’s Website account. Proof of posting does not guarantee that you will be entered into the random draw and will not be accepted as proof of receipt.
  • If the number of entries received reaches any limit or cap before your free entry is received, you will not be entered into that Competition or any other Competition, and no credit will be applied to your Website account.
  • If a Competition is priced lower than the postage cost, multiple entries will be credited for each postal entry, up to the value of second class postage. Example:
    • 49p Competitions – 1 postal entry = 2 competition entries
    • 29p Competitions – 1 postal entry = 3 competition entries
    • 9p Competitions – 1 postal entry = 10 competition entries
  • Entrants must have created an account on the Website/app in order for a free entry to be processed, and all details must match the account details.

4. Choosing a Winner

  1. For Standard Competitions, all Entrants who answer the Competition Question correctly will be placed into a draw, and one Entrant will be selected at random to be eligible to receive the Prize. The random draw will take place as soon as possible and in any event within 7 days of the Closing Date (the “Draw Date”).
  2. All Entrants to a Standard Competition will have their names and entry numbers included in a spreadsheet which may be published on the Website and may be visible during the live draw. If you do not want your name included in this spreadsheet, you must contact the Promoter by email at contact.alphaimperium@gmail.com as soon as possible after completing your entry and, in any event, at least 48 hours before the live draw takes place.
  3. For Instant Win Competitions, prizes are randomly allocated to numbers in a spreadsheet. Each Instant Win Competition entry that correctly answers the Competition Question is then given a randomly allocated number in that spreadsheet. If the number matches a prize, the Entrant wins that prize.
  4. Entrants using either the paid entry route or the free entry route will be notified whether they have won (and, if so, what prize they have won) after submitting their entry by accessing the relevant Instant Win Competition webpage.
  5. Entrants using either the paid entry route or the free entry route will also be notified if they are winners by an automatic email sent to the contact email address provided with their entry. The email will be sent automatically as soon as the Entrant’s number is identified as a winning number. Unsuccessful entrants will be notified by email.
  6. Entrants eligible to win a Prize, as set out in clauses 4.1 and 4.3 above, shall each be referred to as a “Winner” and together as the “Winners”.
  7. For help with entries, please contact us on +447355613982 or email contact.alphaimperium@gmail.com.

5. Site Credit

  1. Site Credit may be awarded as gifts or prizes in certain Competitions.
  2. Certain Competition prizes may be exchanged for Site Credit if this is specified on the Competition webpage.
  3. You may be awarded Site Credit if you provide photos and testimonials from winning a Competition in accordance with the criteria specified by the Promoter from time to time.
  4. Please see our social media campaigns for other ways in which Site Credit may be awarded.
  5. Site Credit must be used within 12 months from the date it is credited to your Website account. Users will receive a reminder 1 month before expiry and again on the day of expiry. After that, Site Credit will expire and cannot be used as a discount for Competition entries.
  6. You can view your current Site Credit balance by logging into your Website account.
  7. Site Credit has no monetary value and cannot be exchanged for cash or real money.

6. Eligibility

  1. The Competition is open to all residents aged 18 or over, except:
    1. employees of the Promoter;
    2. employees of the Promoter’s agents or suppliers who are professionally connected with the Competition or its administration; or
    3. members of the immediate families or households of those referred to in clauses 6.1.1 and 6.1.2 above.
  2. By entering a Competition, you confirm that you are eligible to do so and eligible to claim any Prize you may win. The Promoter may require you to provide proof that you are eligible to enter the Competition and claim the Prize. If you fail to provide such proof or any other information reasonably requested within a reasonable time, you may be disqualified from the Competition.
  3. The Promoter will not accept Competition entries that are:
    1. automatically generated by computer; or
    2. incomplete.
  4. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the Competition. This includes if you are rude or abusive to the Promoter or anyone associated with it.
  5. Subject to clause 12.3 below, no refunds of the entry fee will be given in any circumstances, including:
    1. if, following your entry into the Competition, you later discover that you are not eligible to enter the Competition or claim the Prize;
    2. if, following your entry into the Competition, the eligibility criteria for entering the Competition or claiming the Prize change and you are no longer eligible; or
    3. if you are disqualified from the Competition by the Promoter for any reason.
  6. If an Entrant engages in:
    1. any form of fraud (actual or apparent);
    2. fraudulent misrepresentation;
    3. fraudulent concealment;
    4. hacking or interference with the proper operation of the Website; or
    5. tampering or unauthorised use of any of the code constituting the Website,
      then all of that Entrant’s entries will be declared void, no refunds will be given, and the Entrant may be prevented from entering future Competitions.

7. The Prize

  1. The prize for each Competition is described on the Website (the “Prize”). Prize details are, to the best of the Promoter’s knowledge, information and belief, correct as at the Opening Date.
  2. Prizes are subject to availability. The Promoter reserves the right to substitute any Prize with a prize of equal or greater value. If any Prize details change, the Promoter will use all reasonable efforts to update the Website as soon as possible. For Instant Win Competitions, the prizes listed on the Website are those available to be won. There is no guarantee that all such prizes will be won, and whether and how many prizes are won will depend on the number of Competition entries received.
  3. The Promoter takes reasonable steps to award the Prize as described on the Website. The Promoter makes no further representations or warranties regarding the Prize, its value, its condition, or any other information provided on the Website. The Promoter makes no representation or warranty that the information provided on the Website is accurate, complete, or up to date.
  4. There is no cash alternative for the Prize unless this is stated as part of the Prize; however, the Promoter may (at its sole discretion) offer one if the Winner prefers to receive cash instead of the Prize.
  5. The Prize is non-refundable, non-negotiable and non-transferable.
  6. If the Prize is a vehicle:
    1. unless otherwise stated, the Promoter will ensure that the vehicle has a valid MOT (where required);
    2. the Prize does not include any insurance, and it is the Winner’s responsibility to ensure that the vehicle is properly insured before driving it on public roads (where legally permitted);
    3. the Promoter accepts no responsibility for the Prize once it has been delivered. The Winner is solely responsible for complying with all relevant laws and regulations relating to the vehicle, its operation, and for ensuring it is operated in a safe and responsible manner;
    4. vehicle tax/road tax is not included;
    5. the Winner is responsible for ensuring that they hold the licences, qualifications, knowledge and experience necessary to operate the vehicle safely and legally;
    6. the Winner is solely responsible for ensuring that they have all necessary safety equipment and clothing (for example helmets, boots and gloves) and for wearing them while using the vehicle.
  7. If the Prize is a holiday or an event:
    1. the Prize description will specify the number of tickets included, the class of travel, and the type of carrier to the relevant destination. Depending on the type of Prize, the Winner may have flexibility regarding dates; for example, Grand Prix tickets will be for a fixed date, while a general holiday may be flexible. Excluded dates for holiday prizes are those set out on the Website. The Prize does not include travel insurance, the cost of transfers to and from airports or train stations, food and drink, spending money, taxes or personal expenses, or any other items not specifically stated as included in the Prize on the Website. Any other costs incurred in addition to those set out above and incidental to obtaining the Prize are the responsibility of the Winner(s). A cash supplement may be included in the Prize if expressly stated on the Website; however, this shall be the limit of the Promoter’s liability.
    2. you will be responsible for ensuring that you and anyone travelling with you are available to travel and hold valid passports, any necessary visas, and required travel documentation for the relevant holiday on the specified travel dates. Once dates have been communicated to the travel provider, they cannot be changed.
  8. If the Prize is a property:
    1. the Winner will have the option to choose as the Prize either:
      • the property, furnishings, and cash supplement, in each case as announced and described as the Prize on the relevant Competition webpage on the Website; or
      • a cash prize, as stated as the Prize on the relevant Competition webpage on the Website.
    2. the value of the property stated on the Website is indicative only. The actual value of the property may vary depending on market fluctuations and other conditions.
    3. the Promoter will pay any stamp duty, land tax, and legal costs relating to the transfer of title of the property to the Winner. Any other taxes, costs and fees shall be the sole responsibility of the Winner.
    4. the property may be subject to certain rights of access, restrictions and covenants as set out in the property title documents.
    5. the Promoter reserves the right at any time to replace the Prize with one of equal or greater retail value than the property and furnishings described on the relevant Competition webpage on the Website.
    6. the Winner must cooperate with the Promoter in relation to completing and registering the transfer of ownership and must agree to use all reasonable endeavours to complete the transfer within 90 days of choosing the property as the Prize, failing which clause 8.6 below shall apply.
    7. if the Winner chooses the cash Prize, the Promoter will pay that amount to the Winner within 14 working days of receiving the Winner’s choice and validating the Winner’s bank account details.

8. Winners

  1. The Promoter’s decision is final and no correspondence or discussion will be entered into.
  2. For Standard Competitions, the Promoter will personally contact the Winner as soon as possible after the draw date specified in the Competition listing on the Website (the “Draw Date”), and in any event within 7 days of the Draw Date, using the telephone number or email address provided with the Competition entry. If the Winner cannot be contacted, is unavailable, or has not claimed the Prize within 14 days of the Draw Date, the Promoter reserves the right to offer the Prize to the next eligible Entrant selected (in the same way as the original Winner) from the correct entries received before the Closing Date.
  3. For Instant Win Competitions, Entrants using the paid online route and the free entry route will find out online on the relevant Instant Win Competition webpage whether or not they have won. The Promoter will personally contact Winners as soon as possible after their winning entry and, in any event, no later than 48 hours from the date their entry was received, using the telephone number or email address provided with the Competition entry. If the Winner cannot be contacted, is unavailable, or has not claimed the Prize within 14 days of the Promoter’s first attempt to contact the Winner, the Promoter reserves the right to allocate a new number to the Prize and add it back into the prize pool for that Competition, or otherwise dispose of the Prize as it sees fit, without any liability to the Winner.
  4. The Promoter must either publish or make available information indicating that a valid award took place. To comply with this obligation, the Promoter will publish the Winners’ names and winning numbers on the Website and send the Winners’ names and winning numbers to anyone who entered.
  5. If you object to any or all of your name and winning entry being published or made available, please contact the Promoter at contact.alphaimperium@gmail.com before the Closing Date. In such circumstances, the Promoter must still provide the information to the Advertising Standards Authority on request.
  6. The Promoter reserves the right to withhold a Prize if it reasonably suspects that a Winner is not eligible or has not complied with these T&Cs. In such circumstances, it may dispose of the Prize as it sees fit in its sole discretion.

9. Claiming the Prize

  1. Winners must claim the Prize personally. The Prize may not be claimed by a third party on behalf of a Winner. Details of how the Prize will be delivered to the Winner (or made available for collection) are published on the Website.
  2. If your personal details, including contact information, change at any time, you must notify the Promoter as soon as possible. Notifications should be sent to the Promoter by email to contact.alphaimperium@gmail.com. Notifications must include details of the Competition you entered, your old details, and your new details. If your details change within 10 days of the Closing Date, the Promoter will use your old details if it needs to attempt to contact you.
  3. Any cash Prize will be transferred directly to the Winner’s nominated bank account. The Winner must provide proof that they are the sole or joint account holder. Failure to do so within 14 days will result in disqualification from the Competition and forfeiture of the Prize. In such circumstances, the Promoter reserves the right to offer the Prize to the next eligible Entrant selected from the correct entries received before the Closing Date or, in the case of an Instant Win Competition, to dispose of the Prize as it sees fit, without any liability to the Winner.
  4. The Promoter accepts no responsibility and is under no obligation to pay any compensation if a Winner is unable to or does not collect the Prize.
  5. The Promoter reserves the right not to award any Prize if the Prize is not claimed by the Winner in accordance with these T&Cs.

10. Limitation of Liability

  1. To the extent permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate a Winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize, except where it is caused by the negligence of the Promoter, its agents or distributors, or their employees. Your statutory rights are not affected.
  2. The Promoter shall not be liable for:
    1. any entries not received due to incorrect or inaccurate entry information, faulty or failed data transmissions, or any other reason;
    2. unauthorised access to, theft of, destruction of, or alteration of entries at any time;
    3. technical malfunctions, errors, failures, omissions, interruptions, deletions, defects, delays in operation, or communications line failures, regardless of cause, with respect to any equipment, systems, networks, lines, satellites, servers, computers or providers used in any aspect of operating a Competition;
    4. the inaccessibility or unavailability of network services, any wireless service, the internet and/or any website (including but not limited to any online random selection method for entry into the draw); and
    5. any use of the Prize by the Winner.

11. Data Protection and Publicity

  1. By entering a Competition, you agree that any personal information provided by you with your Competition entry may be held and used only by the Promoter or its agents and suppliers to administer the Competition or as otherwise set out in the Promoter’s Privacy Policy, a copy of which is available on the Website.
  2. If you are the Winner of a Competition, you agree that the Promoter may use your name, image, and town or county of residence to announce the Winner of the Competition. You also agree to participate in any reasonable publicity required by the Promoter.
  3. If a Winner does not wish to participate in any publicity, they must notify the Promoter before the Closing Date. This will not affect your chances of winning the Prize. If you do not agree to participate in publicity relating to the Competition, we may still provide your details to the Advertising Standards Authority. This is a legal requirement that we must comply with in order to prove that the Competition was properly administered and that the Prize was awarded.
  4. If you are the Winner of a Competition, you may be required to provide further personal information and proof of your identity to confirm your eligibility to claim the Prize and transfer title of the Prize to you. You agree to the use of your information in this way. You have the right to request further details about how your personal information is used. You may also withdraw your consent for your personal information to be used in this way, but by doing so you may prevent the Prize from being transferred to you. In such circumstances, you will be treated as having withdrawn from the Competition and you will forfeit the Prize. You will not be entitled to any refund of the entry fee. The Promoter reserves the right to offer the Prize from a Standard Competition to the next eligible Entrant selected from the correct entries received before the Closing Date. The Promoter reserves the right to dispose of the Prize from an Instant Win Competition as it sees fit, without any liability to the Winner.
  5. Please note that under data protection laws, you have the right to request that the Promoter does not contact you and removes your data from its database. If you make such a request, you will withdraw from the Competition, as it will not be possible to contact you if you are a Winner. You will not be entitled to any refund of the entry fee if you withdraw from the Competition. If you do not want your personal data to be used by the Promoter for promotional purposes, please email the Promoter at contact.alphaimperium@gmail.com before the Closing Date.

12. General

  1. The Promoter reserves the right to amend these T&Cs from time to time. The latest version of these T&Cs will be available on the Website.
  2. Draw Extension and No-Refund Policy
  3. If a minimum number of tickets sold, required to cover the value of the Prize, is not reached, the Promoter reserves the right to extend the draw date in order to ensure the fair running of the Competition.
  4. The new draw date will be publicly announced at least 7 days before it takes place.
  5. Entry fees will not be refunded in this situation. Entrants understand and accept that entering the Competition constitutes express and irrevocable agreement to these conditions.
  6. If there is reason to believe that there has been a breach of these T&Cs, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in a Competition and any future Competitions.
  7. The Promoter reserves the right to cancel, suspend, void or amend a Competition where it becomes necessary to do so due to circumstances beyond its control. In such circumstances, the Promoter will refund any entry fees you have paid.
  8. There is no minimum number of entries, and the Promoter will not suspend, cancel, extend the Closing Date, or amend the Competition due to a lack of entries. The draw will take place, and the Prize will be awarded regardless of the number of entries received.
  9. Competitions on the Website are in no way sponsored, endorsed, administered by, or associated with Facebook. By entering the Competitions, Entrants agree that Facebook has no liability and is not responsible for the administration or promotion of the Competitions.
  10. These T&Cs shall be governed by English law. Entrants submit to the jurisdiction of the courts of England and Wales.
